Schmidt says no one will be charged in Aug. '24 shooting death near Wine Cellar...
No one will be charged in connection with the altercation and shooting that occured behind a Jamestown bar last year where a Buffalo man was shot and killed with his own gun.  Chautauqua County District Attorney Jason Schmidt says 25 year-old Corey Johnson suffered a gunshot wound to the head during the altercation behind the Wine Cellar bar at 309 North Main St. during the early morning hours of Aug. 16 of 2024.  Schmidt says Johnson died a short time later at UPMC Hamot Medical Center in Erie, Pennsylvania.  He adds that a number of items... including the 9-mm handgun used... were taken into physical evidence... and, his office and other investigators reviewed multiple suveillance video recordings that captured the incident from different viewpoints.  He says several businesses in the area helped by providing their video records.  Schmidt says Johnson was the "first and only person" to introduce a deadly weapon into the interaction... and, then demonstrated his intent to use the gun against another person by chasing after and repeatedly trying to shoot that person.  The DA says a subsequent struggle between the two men led to Johnson being fatally shot.  Given those facts... Schmidt says "the deadly physical force provisions of New York' s self-defense/justification law provide an absolute defense to the person who may have pulled the trigger during the final struggle resulting in Mr. Johnson’s death."
